A controversial nightclub which failed in a landmark challenge to a cut in its opening hours is expected to make an announcement about its future today.

Funky Mojoe, in High Road, South Woodford, launched a High Court bid to overturn a decision to limit its opening times to normal pub hours following crime and anti-social behaviour.

The High Court upheld the decision and ordered Funky Mojoe to pay the council’s legal costs of £127,000, while denying the club the right to appeal.

It is the first time the court has ruled on a nightclub's license.

However, it has emerged the club can appeal against an initial Magistrates Court ruling to uphold the council’s decision to cut trading times.

Funky Mojoe management have so far declined to comment, but the venue remained closed at the weekend.

Yesterday licensee Kerry O’Reilly tweeted: “Great meeting today more news will be announced on Thursday can't wait to tell you all.

“Thank you for your support see you all soon.”

Banners still remain outside the venue and on the club’s website stating it has a late license until 1.30am.

Cllr Richard Hoskins believes the club is unlikely to win any further legal challenge.

He said: “If they do appeal again they are going to have to have to argue against all the evidence which was thrown against them.

“I don’t know what they are planning to do. They have got a big decision to make now.

“They have already spent around half a million on this so it’s up to them if they want to spend more.”

After the result was announced last week, Miss O’Reilly tweeted regarding a meeting she was due to have with a licensing solicitor.

Opening hours were reduced earlier this year after the council's licensing committee was shown evidence that the venue had become “a magnet” for serious trouble.

CCTV footage at the hearing showed a series of violent assaults outside the venue.
