A man will appear in court accused of killing David Joslin, who intervened to stop a fight in Chingford almost five years ago. 

The 23-year-old 'peacemaker' died after being knocked unconscious by a single punch in Old Church Road, Chingford, on December 19 2009. 

He died eight days later. 

Michael Oliver, 33, of Poundfield Road, Loughton, has been summoned to court accused of manslaughter.

In an unusual legal move, the Crown Prosecution Service said Mr Oliver has not been formally charged, but is accused of the crime.  

He will appear at Barkingside Magistrates Court on November 10. 

In March 2013, an inquest into the death revealed failings by Whipps Cross University Hospital in Leytonstone, which initially wrongly treated Mr Joslin as a drunk. 

He was said to be in a state of agitation consistent with a brain injury and told stafff he had been assaulted, yet was left for seven hours to sober up.

He was also not given a CT brain scan until 19 hours after his arrival.

The family have said they are delighted by the development. 

Mr Joslin father Phillip, of Kimberley Road, Chingford, said: "We as a family are absolutely delighted someone is finally being brought to justice and taken to court charged with our son's murder. 

"It has been a very long struggle." 

A CPS spokeswoman said: "The CPS have authorised the Metropolitan Police Service to summons Michael Oliver for the manslaughter of David Joslin in December 2009.

"This decision was taken in accordance with the code for crown prosecutors.

"Oliver will appear at Barkingside magistrates' Court on 10 November 2014."
