A father and son have been fined after they claimed they couldn’t remember who was caught speeding in their car.

Gabriel Tun, 24, and Lionel Tun, 53, both of The Chantry, Fulbourn, Cambridgeshire, were each given six points on their licence and fined a total of more than £1,000 at Colchester Magistrates’ Court on Friday, August 25.

The original offence took place in July 2013 on the M25 in Epping, when a silver BMW M3 was caught travelling at 95mph in a 70mph limit.

The car was registered to Gabriel, with Lionel as a named driver on the insurance policy.

Both were written to and a request for driver details to be confirmed was made.

Gabriel and Lionel responded to letters, stating they could not remember who was driving at the time of the offence.

The case was then sent to court, where both men were convicted.

Gabriel was ordered to pay a fine of £1,015, costs of £155 and a victim surcharge of £30. Lionel was ordered to pay a £210 fine, costs of £155 and a victim surcharge of £30.

PC Daniel Cordwell, of Essex Police, said: “If you are sent a notice requesting details of who was driving at the time of an offence, we will not accept an ‘either, or’ response or that of not remembering who the driver was.

“The registered keeper is under a greater burden to provide these details, however a named driver also holds a certain amount of responsibility.

“In this case both men were found guilty and received points on their licence and large fines as a result of their actions.”
