LEYTONSTONE: Council forced to refund thousands in traffic fines

THOUSANDS of pounds in traffic fines will be refunded by Waltham Forest Council after the Government said a controversial box junction may have broken official guidelines.

A box junction was installed at the junction of Leytonstone High Road and Burghley Road last summer, purportedly to keep the junction clear because of temporary roadwork closures, although it has remained there since.

Over the past few months a council CCTV smart car has regularly been sitting opposite the junction snapping people as they enter it, causing fury among motorists, many of whom believe the council has been exploiting traffic congestion to make money.

But following complaints, the council asked the Department for Transport (DfT) for advice on whether the junction breaks regulations.

A DfT spokesman said: "We have offered a view that the road marking may not meet the Traffic Signs and General Directions 2002 because it appears to overlap a cycle lane."

As a result, the authority is now no longer fining people for stopping in the junction, it has cancelled all outstanding fines and is urging people who have been fined there in the past to contact them for a refund.

The news delighted Leytonstone resident George Panteli, who in October unsuccessfully appealed his fine on the basis that the box was too long.

The council's environment cabinet member Cllr Bob Belam had insisted at the time that the junction complied with regulations.

Mr Panteli, 51, of Harold Road, described the council's decision as a "victory for motorists."

He said: "The council deserves all it gets and I am jumping for joy, they fined thousands of people there, although many people won't realise they can get their money back, of course."

Mr Panteli had been planning to take his appeal to an independent parking adjudicator.

He said: "I can't believe the council is refunding all the fines, but I am impressed by this, it is the right thing to do."

Another motorist, Richard Kingswood had his fine cancelled shortly before he was due to take it to an adjudicator.

He said: "With the recent revelation that Waltham Forest have netted more than £4m in parking and traffic fines it is surely high time that they cleaned up their act and started applying the law correctly, ethically and in accordance with their stated policies."

The councillor in charge of traffic and parking has apologised "unreservedly" to motorists and residents for the gaffe that led to thousands of traffic fines being issued incorrectly.

Environment cabinet member Cllr Bob Belam said: "The council is carrying out a thorough investigation to find out why this happened and will be taking steps to ensure that a similar occurence does not happen again.

"As soon as we discovered this error the council instructed our parking contractor to stop issuing tickets incurred by motorists at this junction and have cancelled all outstanding tickets.

"If anyone feels they have been given a fixed penalty at this box junction in error they should contact our parking section and a full refund will be made."

Notices will be placed in the council's WFM newsletter informing motorists they can get their fines refunded.

Cllr Belam said that a decision has yet to be made on whether the junction will be removed or merely altered.

Since every ticket issued is automatically logged centrally, the Council surely can find out pretty quickly from work rosters who was ticketed, and the address they sent the ticket to: so why should people have to apply? LBWF don't seem to have any trouble issuing the dam' things in the first place. Perhaps in future they can invite us to apply personally if we think we've committed a traffic offence.
'As soon as we discovered this error' sounds very like 'as soon as we were caught': it used to be a Councillor's job to protect us against the bureaucracy, not defend it against us.

The refunds should be made authomatically. The council have the Registered Keepers details and the Treasurer's Receipts. If the details are the same then refund.
If they are not, then they should write to the Registered Keeper to begin the enquiry to establish who paid.
The council cannot keep any unlawfully derived income.

The other significant point is the acknowledgement that a sign (or road marking)does not comply ... hence refunds need to be made, which is what we have been saying all along.

With each passing day, it must become more and more embarrassing for those employees of LBWF who try to do a decent day's work, to be associated with this shambles of a council.

I am pleased that Bob Belam has been able to assure us that this will now be dealt with.

Can he re-assure us that these mobile CCTV cameras will be re-assigned to more useful work? Lets go after real criminals and not innocent car drivers. How about covering Walthamstow High Street? They can deal with speeding by cars in a pedestrian area, and usefully be used to obtain evidence on gangs of criminals - thieves, shell game scammers, and DVD sellers - who've been able to operate there regularly with little effective action by the Police.

Not to sure I believe the "As soon as we discovered..." statement. I reported this to the council in mid January as part of my appeal against them. Although they were forced to cancel MY fine it was not until I reported it to the Guardian on Monday that they decided to refund everybody elses!

Waltham Forest Council have now agreed to write individually to everyone who has not yet claimed their refund in order to apologise and return their money.

Note, however, that Waltham Forest moving traffic PCNs were not legally valid documents anyway and, in reality, many more refunds are owed than simply those for this yellow box...

The London Borough of Waltham Forest is the 5th District or Borough I have lived in as a Rate Payer or Council Tax Payer. Over the last 3 years, it has consistently proved itself to be the worst. Even getting a waste bin ordered takes repeated chasing.

Therefore, it is not surprising that LBWF is unable to organise itself to refund illegal fines. It was only by chance when I complained to the Leader of the Council, C Loakes, that it was keen to fine people for a partial infringement of a box junction, but ignore graffiti and bad behaviour outside the Wood Street CCTV zone that I discovered it was illegal junction.

All this nonsense about it is difficult to trace people is just that. They have the car registrations and I am sure DVLA could help trace owners or drivers if addresses have changed.

As a local authority, I have little confidence in LBWF and the incompetence comes from the top in the form of C Loakes, who commands no respect from me whatsoever.
