WALTHAM FOREST: Auditors decided poor fund fiasco should not affect council rating


AUDITORS knew the extent of the council’s failure to mange millions of pounds earmarked to help deprived areas but decided it should not affect the authority’s performance rating.

Waltham Forest Council was given three-stars following a recent assessment by the Audit Commission, which pushed the authority’s overall rating to the highest possible score.

This is despite the revelation of widespread and long-term systematic failings to manage money from the Neighbourhood Renewal Fund (NRF).

The performance assessment was conducted while anti-fraud investigations were being carried out into a number of suspect contracts awarded by the council.

The probes revealed many deals had not followed rules to prevent fraud, spending was poorly monitored and, in many cases, no signed contract could be found.

Auditors knew about the investigation’s findings before finalising the council’s rating, but decided the scandal only deserved a passing mention in its subsequent report.

The reports states that the Local Strategic Partnership (LSP), which is the accountable body for NRF and chaired at the time by council leader Clyde Loakes, is “well led and focused in its approach to meeting community priorities”.

It continues: “the Council has identified and reported weaknesses in the commissioning and procurement of contracts for central government grant funded programs between 2004 and 2006.

“Procurement practice supports priorities but lack of compliance with the Council’s procedures could expose the Council to risk of legal action.”

When asked why the serious failings did not affect the outcome of the assessment, an Audit Commission spokeswoman said: "When the corporate assessment took place the investigation into BNI/NRF was still ongoing and the outcome could not be second guessed.

“Although we look at the council's relationship with the LSP and how it manages various aspects such as NRF, it was not assessed specifically as it is a small part of a broader overall assessment.

“That is not to say that it is unimportant, but when the investigations were completed, the decision was taken that it did not affect the score.”

She added that plans are in place to change the assessment criteria to ensure greater scrutiny in the future.

Nick Tiratsoo, whose research has uncovered many of the failings under NRF/BNI, said: “'Many fear that Audit Commission rating exercises sometimes depend upon "tick box" investigations, where Council's use expert advice, gaming strategies, and their network of contacts to gain good results.

“The Waltham Forest case does little to provide reassurance. The facts about the local NRF/BNI fiasco are by now well known. Since 2004, millions of pounds worth of public money, meant to improve life in the poorer wards, has been squandered, largely because of wholly avoidable mismanagement.

“That the Audit Commission apparently did not pick this up unfortunately speaks for itself'.

Police are currently examining allegations that EduAction, the company which used to run education in the borough, used NRF money to boost profits.

Five council officers are also under investigation for not reporting concerns that public funds were being misused.

Cllr Loakes has resigned as chair of the LSP but has refused to take any responsibility for the fiasco.

I think Nick Tiratsoo's hit the nail on the head there.

Loakes has some friends in Government but once the true extent of all this hits the fan let's see whether they'll still be so keen to protect him then.

Directly provide services to improve teh community in a transparant and accountable way - 0 stars.

Please could you name the 'audit commission spokeswoman', who is peddling this balderdash for a living?

The Audit Commission, under Chief Executive Stephen Bundred, have the audacity to tell us on their website that they are an 'independent watchdog, driving economy, efficiency and effectiveness in local public services to deliver better outcomes for everyone.

In 1998, Bundred was the subject of a damning European Union alleging that in his capacity as the then Chief Executive of Camden Council he encouraged the illegal diversion of European cash to bail out a firm run by a colleague and Councillors. The report accused Bundred of ignoring his duty to report evidence of potential criminal activity. (Does any of this sound familiar to students of Mr Loakes handling of the current scandals in Waltham Forest?)

The attack on Bundred came after a two-year fraud inquiry by Brussels anti corruption unit UCLAF.

Investigators concluded there was evidence of fraudulent trading, criminal conflicts of interest, local government corruption, perjury and fraud in an immigrant training scheme.

Bundred was accused of a conflict of interest when, as the Councils Director of Finance, he discovered the company running the scheme was effectively insolvent. Fraud squad investigators produced reports that showed how Bundred seconded staff and drew up a complex £400,000 loan scheme to bail the company out. This allowed it to qualify for further EU loans. The report was so damning it was put in the hands of the Government, the district auditor and the Police.

I have to say I found the District Auditor, Nigel Johbnson of Deloitte's, attitude to all this quite disgraceful. I know for a fact that he received tens of complaints earlier this year asking him to step in and investigate. He ignored most of the letters sent to him and told one person that he wasn't going to investigate because the council were investigating themselves. Now, the Audit Commission, whom Mr Johnson represents in Waltham Forest, award this council 3 stars and say the serious nature of the alleged malpractice and irregularities "doesn't matter" . The Guardian should ask Mr Johnson for an explanation of why he, as Waltham Forest's District Auditor, ignored the complaints of tems of concerned local residents' whose money the council are spending. Someone should also try and find Waltham Forest's former Chief Executive Jacquie Dean, also formally of the Audit Commission, and ask her what she thinks all of this. Ms Dean's departure was far too quiet and far too shift.

I was interviewed by the Audit Commission Inspectors and talked to them at some length about the BNI/NRF fiasco including offering to provide them with further evidence and put them in touch with witnesses. They chose not to take advantage of that opportunity and instead conducted a pre-ordained superficial inspection of not much really having already been given their orders about what the outcome would be.

The awarding of 4 Stars to a Council that the majority of residents do not recognise as worthy of them yet just goes to prove that the inspection regime is as failed and incompetent as Loakes' leadership of the LSP has been.

How anyone can take the Audit Commission seriously after their deliberate decision to ignore a major scandal in order to make a failing Labour administration look better than they are is beyond the understanding of anyone not in the Labour party.

There is only one way to achieve the type of Council that the people of the Borough want and that is, come 2010, to vote Conservative and nothing else.

Matt, there are possibly a few naive souls left in denial in the Labour Party, but most of the good people have walked out in disgust. The rump we are left with are either stupid patsies or up to their eyeballs in the public trough.

There is a very influential cabal of greedy and mediocre people within Labour all protecting each other. They are like a freemasonry which help each other on in their careers from one opportunity to feather their nests at the public's expense to another; from one public institution to the next. The audit commission, like our local authority, have been victims of these kinds of parasites on our public life like many other once great public bodies under this government.

Between 2002 and 2006, LBWF's NRF programmes were jointly headed by both Liberal Democrat and Labour portfolio holders in the council coalition. Just a brief look at some the minutes of meetings regarding some of the NRF projects currently under suspicion/investigat
ion - the 2004-2006 Youth At Risk programme for example - shows that the portfolio holders responsible came from both local political parties. Clyde Loakes needs to take some blame, but definitely not independent of both the Labour and Liberal Democrat cabinet members he put in charge of these projects. They know who they are.

In my earlier posting I suggested that the CPA system borders on the corrupt. Matt Davis's comments show the Audit Commission (who are responsible for CPA) to be incompetent.

Walthamnster, I would find out who the Head of the North East London District Office is and send a complaint to him or her. I would make sure to copy in all three of our local MPs and the local Guardian as this is a matter of public interest. Let us know if you find any info on who the head of the NE London District office is.

But my previous efforts, including contacting the Audit Commission Complaints Unit, were a total waste of time.

I was given the address and emailed it twice. Each time, I got an automatically generated response saying "If your complaint can be investigated within the remit of the Audit Commission's complaint procedure, we will respond within 10 working days advising you of the appropriate action that will be taken."

Despite sending further emails, I never had another response.

So on second thoughts, I think anyone who cares should write directly to our local MPs, and to Hazel Blears MP who is Secretary of State for Communities and Local Government.
