The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 37) Order 2020; The Waltham Forest (Charged-For Parking Places) (Amendment No. 37) Order 2020 (HE) The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 38) Order 2020; The Waltham Forest (Charged-For Parking Places) (Amendment No. 38) Order 2020 (HH EXTN 1) The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 39) Order 2020; The Waltham Forest (Charged-For Parking Places) (Amendment No. 39) Order 2020 (HHE) 1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Waltham Forest on 16"1 April 2020 it made the above-mentioned Traffic Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, the general effect of which will be to:

(a) continue indefinitely the provisions of The Waltham Forest (Charged-For Parking Places) (Amendment No. 143) Experimental Order 2019 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No.



177) Experimental Order 2019, the effect of which provided the 'Hale End' (HE) Controlled Parking Zone and included:-



(i) permit holder's parking places (for the use of vehicles in respect of which a 'HE' permit or other valid permit has been granted), operating Monday to Saturday, 8 am to 6.30 pm, and waiting restrictions, operating either Monday to Saturday, 8 am to 6.30 pm or 'at any time' at road junctions, dropped kerbs and other locations vulnerable to obstruction, in: Beacontree Avenue (section south of Belle Vue Road), Belle Vue Road, Castleton Road, Forest Road (north side between Hale End Road and Beacontree Avenue - including an inset parking place in line with the footway), Hale End Road (section south of Belle Vue Road - including partially on the footway), Hillcrest Road, Ulverston Road, Woodstock Road;



(ii) formalised disabled persons' ('blue badge') parking places, operating 'at any time' in: Belle Vue Road (northern side - outside Nos. 66/68 (x1)); Castleton Road (east side (total of 4 bays) - outside Nos. 8/10(x1), 14/16(x1), 24/26(x1), 34/38(x1)); Ulverston Road (both sides (total of 7 bays) - outside Nos. 6/8(x1), 15/17(x1), 18/20(x1), 30/32(x1), 60/62(x1) and 66/68/70(x2)); and Woodstock Road (east side - outside Nos. 66/68 (x1));



(iii) The following properties (all E17 streets) will continue to be eligible to apply for 'HE' permits: all properties in Beacontree Avenue (section south of Belle Vue Road) - Nos. 1 to 30 (inclusive except No. 13), Belle Vue Road - Nos. 2 to 88 (evens inclusive) and Nos. 1 to 43 (odds inclusive except No. 19 and 31), Castleton Road - Nos. 2 to 70 (evens inclusive except Nos. 36 and 66) and Nos. 1 to 43 (odds inclusive except Nos. 29, 51, 53 and 69), Forest Road (north side between Hale End Road and Beacontree Avenue) - Nos. 947 to 1051 (odds inclusive except Nos. 997, 999, 1001, 1015 and 1019), Hale End Road (section south of Belle Vue Road) - Nos. 2 to 72 (evens inclusive) and Nos. 3 to 43 (odds inclusive except Nos. 13), Hillcrest Road - Nos. 2 to 74 (evens inclusive) and Nos. 1 to 67 (odds inclusive except Nos. 19 and 21), Ulverston Road Nos. 2 to 70 (evens inclusive except Nos. 46, 48 and 50) and Nos. 1 to 85 (odds inclusive except Nos. 31, 43, 57, 59 and 61), Woodstock Road Nos. 2 to 74 (evens inclusive except Nos. 18, 20, 22, 24, 26) and Nos. 1 to 63 (odds inclusive)



(b) continue indefinitely the provisions of The Waltham Forest (Charged-For Parking Places) (Amendment No. 144) Experimental Order 2019 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No.



178) Experimental Order 2019, the effect of which provided the 'Higham Hill' (extension No. 1) (HH(extnl)) Controlled Parking Zone and included:-



(i) permit holder's parking places (for the use of vehicles in respect of which a 'HH' permit or other valid permit has been granted), operating Monday to Fridays, 8 am to 6.30 pm, and waiting restrictions, operating either Monday to Fridays, 8 am to 6.30 pm or 'at any time' at road junctions, dropped kerbs and other locations vulnerable to obstruction, in: Carlton Road (CLT), Faulkner Mews (FLK), Higham Hill Road (HGH) (section between Billet Road and Manor Road), Manor Close (MNC), Manor Road (MNR) (the remainder of the street) and Mount Pleasant Road (MNP) (the remainder of the street);



(ii) in Higham Hill Road - west side outside Nos. 323 to 329 HGH - converted a Loading Place and introduce a Free Short Stay parking place operating Mon - Fri 10am to 6.30pm with a maximum stay of 30 minutes and no return within 2 hours;



(iii) formalised disabled persons' ('blue badge') parking places, operating 'at anytime' in: Higham Hill Road (both sides (total of 2 bays) - outside Nos. 354 (x1) and 423 (x1) HGH); Manor Road (both sides (total of 3 bays) outside Nos. 43, 48 and 54 MNR;



The following properties (all E17 streets) will continue to be eligible to apply for 'HH' permits: Carlton Road Nos. 1 to 128 (all inclusive); Faulkner Mews Nos. 1, 2 and 3; Higham Hill Road Nos. 314 and 318 and Nos. 324 to 368 (inclusive evens only); Manor Close Nos. 1 to 21 (all inclusive), Manor Road - Nos. 25 to 39 (inclusive odds only), Nos. 40 to 50 (all inclusive), Nos. 52 to 64 (inclusive evens only), Nos. 65 to 75 (inclusive odds only), Nos. 76 and 77, Nos. 79 to 111 and 123 to 135 (inclusive odds only); Nos. 112 to 122 (all inclusive) and Mount Pleasant Road Nos. 30 to 76 (all inclusive - excluding Nos. 31, 33 and 67), Nos. 77 to 125 (inclusive odds only),

(c) continue indefinitely the provisions of The Waltham Forest (Charged-For Parking Places) (Amendment No. 154) Experimental Order 2019 and The Waltham Forest (Free Parking Places, Loading Places and Waiting, Loading and Stopping Restrictions) (Amendment No. 187) Experimental Order 2019, the effect of which provided the 'Higham Hill East' (HHE) Controlled Parking Zone and included:-



(i) permit holder's parking places (for the use of vehicles in respect of which a 'HHE' permit or other valid permit has been granted), operating Mondays to Saturdays, 8 am to 6.30 pm, and waiting restrictions, operating either Mondays to Saturdays, 8 am to 6.30 pm or 'at any time' at road junctions, dropped kerbs and other locations vulnerable to obstruction, in: Billet Road (section between Higham Hill Road and North Countess Road - south side), Bosworth Close (BW), Fair View Close (FV), Guildsway (GW), Heron Close (HR), Kelmscott Close (KLM), Lyne Crescent (LYN), Millfield Avenue (MLL), Shaw Square (SHW), Wigton Road (WIG), Williams Avenue (WLL) (the remainder of the street). Fair View Close, Kelmscott Close and Shaw Square indicated by the sign "Permit holders parking only past this poinf with no specific parking places marked on the carriageway);



(ii) formalised disabled persons' ('blue badge') parking places, operating 'at any time' in: Guildsway (east side (total of 1 bay) - outside Nos. 11/13 GW); Kelmscott Close (southern side (total of 1 bay) outside Nos. 8 KLM; Lyne Crescent (both sides (total of 3 bays) - outside Nos. 25/27 (x1), 32 (x1) and 33 (x1) LYN); Millfield Avenue (all sides (total of 6 bays) - outside Nos. 4,19, 32, 37, 40 and 45/47 MLL); Shaw Square (all sides (total of 2 bays) - outside Nos. 1/2 (x1) and 11/12 (x1) SHW); Williams Avenue (southern side (total of 1 bay) outside Nos. 7 WLL;



The following properties (all E17 streets) will continue to be eligible to apply for 'HHE' permits: Bosworth Close - Nos. 1 to 28 (all inclusive); Fair View Close - Nos. 1 to 32 (all inclusive); Guildsway - Nos. 1 to 24 (all inclusive); Heron Close - Nos. 1 to 14a (all inclusive); Kelmscott Close - Nos. 1 to 10 (all inclusive); Lyne Crescent - Nos. 1 to 67 (all inclusive); Millfield Avenue - Nos. 1 to 143 (all inclusive); North Countess Road - No. 75 Higham Hill library only; Shaw Square - Nos. 1 to 14 (all inclusive); Wigton Road - No. 1 Roger Ascham primary school and Nos. 2 to 32 (inclusive evens only); Williams Avenue - Nos. 2 to 12 (inclusive evens only) and Nos. 1 to 35 (inclusive odds only), New parking permit eligibility and other criteria, along with variations in pricing for certain parking permits based on vehicle emissions will apply on the anniversary/renewal of any existing permit granted for use in the aforementioned CPZs. 2. The Orders will provide that residents' permits, business permits, charity permits {eligible for charities registered with the Charities Commission only), visitors' permits, school staff term-time only permits, residents' foreign vehicle permits, essential user permits, carers permits and tradespersons' permits, may be granted, on payment of the appropriate charge as specified in item 4 following, to a person who is the keeper of a passenger vehicle (having 8 passenger seats or less) or a certain type of goods vehicle or a motor cycle, providing that in the case of -



(a) a residents' permit, they are a resident of a property eligible to purchase permits as listed in a Schedule to this Notice and their vehicle is UK registered to that address;



(b) a foreign vehicles residents' permit, they are a resident of a property eligible to purchase permits as listed in a Schedule to this Notice and their vehicle is registered outside of the UK;



(c) a business permit or charity permit or business visitor's permit, they have a business or charitable organisation in a property eligible to purchase permits as listed in a Schedule to this Notice and that the permit is for a vehicle which is essential to the operation of that business or charity and is used in the purchase and sale of goods or services in connection with that business or charity;



(d) an essential users permit or carers permit, they are either a doctor or carer who has a surgery in or works in the London Borough of Waltham Forest, or employed by or contracted to the Council, or employed by or contracted to a health authority, or employed by the Metropolitan Police (including Police officers), or employed by the London Fire and Civil Defence Authority, or a company that services fire-fighting appliances and for whom the use of a vehicle is essential to the carrying out of their public service duties, or to any carer registered with the Council who is in receipt of a DWP Carers Allowance and who is providing care to a resident living in a CPZ in the London Borough of Waltham Forest ('the borough'), regardless of whether or not that carer resides in the borough, in a street or part of a street specified in items 2(b) to (e) preceding; The Council will, in addition, consider applications for a carers permit on a case by case basis from carers who are not in receipt of a DWP Carers Allowance but who provide care to a resident living in a CPZ in the borough. Medical documents will need to be provided to the Council by the resident receiving care to support such an application. In such a case the carers permit will be charged at the current resident parking permit charge rates.



(e) a school staff term-time only permit, they are a registered member of staff at a primary or secondary school situated in a street or part of a street specified in items 1 (a) to (b) preceding, who has a bona fide reason to drive to that school;



(f) a tradespersons permit, which may be applied for by CPZ residents on the behalf of tradespersons engaged in work at their home address in or near a street or part of a street specified in items 1 (a) to (b) preceding; or



(g) a visitors' permit, if they are a resident of a street or part of a property eligible to purchase permits as listed in any Schedule to this Notice and that such visitors permit is to be used by a bona fide visitor to their home.



3. The charges for permits (per vehicle band, where applicable) for use in the permit holders' parking places referred to in items 1 (a) to (b) preceding are as follows:-

4. Copies of the Orders, which will come into operation on 16'" April 2020 and all other relevant documents can be inspected on request by emailing

traffic.scheme@walthamforest.aov.uk

during normal office hours on Mondays to Fridays inclusive until the expiration of a period of 6 weeks from that date.



5. Any person desiring to question the validity of either of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks of the making of the Orders, make application for the purpose to the High Court.
